"Late yesterday, a California federal judge joined New York and Nebraska judges in recognizing the unconstitutionality of the first-ever federal abortion ban signed into law by President Bush on Wednesday. All three federal judges recognized that the absence of a health exception in the law violates the U.S. Supreme Court’s ruling in Stenberg v. Cahart that struck down a virtually identical Nebraska law.
With these three temporary restraining orders, the majority of abortion providers in the nation can continue to provide safe abortion care to their patients without fear of prosecution.
We will continue to fight this dangerous law until the courts strike it down, just as we did three years ago in Stenberg v. Carhart."
