The language of the comment affirms that abortion is a human right, that preventable maternal deaths are a violation of the right to life, and that the right to life begins at birth.</span></p> <p><strong><span>“This is an important affirmation which will provide strong support for our global advocacy, litigation, and research that defines and enforces abortion as a fundamental human right,” </span></strong><span>said Nancy Northup, President and CEO of the Center for Reproductive Rights. <strong>“The General Comment on the Right to Life provides the international community with a much-needed framework to hold governments accountable for the high rates of death and injury which occur when women are forced to seek out unsafe abortions.” </strong> </span></p> <p><strong><span>“Comprehensive reproductive health services, including abortion, are necessary to guarantee the right to life, health, privacy, and non-discrimination for women and girls,” </span></strong><span>added Northup<strong>.  </strong> </span></p> <p><span>This critical advancement puts women’s health and bodily autonomy at the top of human rights conversations by requiring states to provide safe, legal, and effective access to abortion including when the pregnancy presents a threat to the woman’s health or will cause her substantial pain or suffering, particularly in pregnancies resulting from rape or incest. The groups assert that the immigration detention system has proven itself incapable of handling the healthcare needs of vulnerable populations, and the letter provides specific examples of pregnant individuals who experienced inadequate care and mistreatment while in detention.  </p> <p> “<b>No one, regardless of immigration status, should be denied necessary reproductive healthcare</b><b>,” </b>the letter reads<b>.</b></p> <p>The letter states that the pregnant individuals in detention have experienced,<b> </b>“<b>delayed access to prenatal care, threatening both the pregnant individual’s health and the health of their fetus.  </b><b>Some women have tragically suffered miscarriages while being held in detention. has announced it intends to approve a change to the label for Mifepristone (known as Mifeprex®), a drug used to end an early pregnancy, in order to better reflect current medical practice and years of politically motivated restrictions that have forced physicians to prescribe Mifepristone according to the outdated, inferior, and less effective FDA label originally approved in 2000.    </p> <p>The Center for Reproductive Rights is currently working with our partners and health care providers in states across the country to determine the impact on women seeking medication abortion in light of constitutionally guaranteed right to safe, legal abortion."</strong></p> <p>The Center for Reproductive Rights has challenged unconstitutional restrictions on medication abortion in four states in the last few years.  Restrictions challenged by the Center have been in effect in <a href="//www.reproductiverights.org/press-room/full-5th-circuit-court-refuses-to-consider-texas-law-shuttering-abortion-clinics-statewide">Texas</a> and <a href="//www.reproductiverights.org/press-room/North-Dakotas-Highest-Court-Upholds-Unconstitutional-Restrictions-on-Medication-Abortion">North Dakota</a> since 2013 and 2014 respectively, while challenges to restrictions on medication abortion in <a href="//www.reproductiverights.org/press-room/state-court-continues-to-block-arizonas-politically-motivated-restrictions-on-medication-abortion">Arizona</a> and <a href="//www.reproductiverights.org/press-room/oklahoma-supreme-court-fails-to-permanently-block-states-unconstitutional-restrictions-on-medication-abortion">Oklahoma</a> are currently enjoined as they move through the courts.</p> <p>Women in the United States have been safely and legally using medication abortion for over nearly two decades, with approximately one in four women who make the decision to end a pregnancy in the first nine weeks choosing this method.  Major medical groups oppose laws which severely restrict access to medication abortion.  Both the American Medical Association (AMA) and the American College of Obstetricians and Gynecologist (ACOG) have submitted amicus briefs opposing restrictions on medication abortion in <a href="//www.reproductiverights.org/sites/default/files/documents/29%20-%202014-04-22%20-%20Amicus%20Brief%20of%20AMA%20and%20ACOG.pdf">Arizona</a> and <a agreed to advance a proposed bill that would allow women to access safe and legal abortion services in cases of life-endangerment, sexual violence, and fatal fetal impairments.</p> <p>The legislation, which was introduced by President Michelle Bachelet in January 2015, will face a Senate vote before heading to President Bachelet for her signature. On March 1, the Constitutional Commission within the Cámara de Diputados approved the bill. Chile’s Health Commission approved the abortion bill in September 2015.</p> <p>Chile is one of six countries in the region that does not explicitly permit abortion under any circumstances. Nearly 200,000 unsafe abortions occur each year in Chile, according to the Guttmacher Institute.</p> <p>Said Lilian Sepúlveda, vice president of the global legal program at the Center for Reproductive Rights:</p> <p><strong>“For almost three decades Chilean women have put their health and lives at risk if they need to end a pregnancy. This has to stop once and for all.  </strong></p> <p><strong>“The Cámara de Diputados took a critical step in putting an end to Chile’s abortion ban and bringing the country in line with the more than 35 countries across the globe that have liberalized their abortion laws over the past two decades.</strong></p> <p><strong>“Now the Senate must follow the lead of President Bachelet, the Cámara de Diputados and the Health Committee by passing this historic bill that supports women’s health and human rights.” </strong></p> <p>Although Chile’s 1931 health code legalized abortion in limited circumstances, a law passed in 1989 banned abortion under all circumstances – even when pregnancy endangers the woman’s life. In 2008, the most recent year data is available, more than 33,000 women were hospitalized due to abortion complications according to the <a href="http://web.minsal.cl/portal/url/item/b53faf5d1d527a52e04001011e010ef5.pdf">Chilean Ministry of Health</a>.</p> <p>In June 2015, the U.N. Committee on Economic, Social and Cultural Rights (<a href="//www.reproductiverights.org/press-room/un-committee-calls-for-abortion-law-reform-in-chile">U.N. CESCR</a>) called on Chile to quickly approve legislation to reform its restrictive abortion law. The U.N. CESCR oversees compliance with the International Covenant on Economic, Social and Cultural Rights, a treaty obligating member states to ensure equal enjoyment of a broad range of rights, including the right to sexual and reproductive health, for all individuals.</p> <p>In a report to the U.N. CESCR, the Center for Reproductive Rights argued that the total criminalization of abortion and the restrictive access to emergency contraception in Chile violate women’s rights to health, non-discrimination and substantive equality, as well as the right to non-regression, since women previously had access to legal abortion in limited circumstances.</p> <p>According to a <a href="//www.reproductiverights.org/document/abortion-worldwide-20-years-of-reform">2014 report</a> published by the Center, 35 countries have amended their laws to expand access to safe and legal abortion services in the last 20 years—a trend that has marked incredible progress toward improving women’s lives, including significantly reducing rates of maternal mortality due to unsafe abortion.
